Refund Policy for Totality Contracting
Last Updated: January 12, 2026
Introduction
This Refund Policy outlines the terms and conditions under which Totality Contracting ("we," "our," "us," or "Company") may provide refunds for deposits, payments, and services. Because we provide custom contracting services rather than standardized products, our refund policy differs from typical retail refund policies.
Please read this policy carefully before making any payments or entering into a contract with us. By making a payment or signing a contract, you acknowledge that you have read, understood, and agree to this Refund Policy.
Nature of Our Services
Totality Contracting provides custom contracting and construction services. Each project is unique and tailored to the specific requirements of our customers. Unlike retail products, our services involve:
-
Custom design and planning
-
Purchase of materials specific to your project
-
Scheduling of labor and subcontractors
-
Permits and regulatory compliance
-
Physical work performed at your property
Due to the custom nature of our work, refunds are handled differently than product-based businesses.
Deposit Refunds
Initial Deposit
When you sign a contract with Totality Contracting, you will typically be required to pay an initial deposit. This deposit is used to:
-
Reserve our schedule and commitment to your project
-
Cover initial design, planning, and permitting costs
-
Purchase materials specific to your project
-
Secure subcontractors and schedule labor
Deposit Refund Conditions
Before Work Commences:
-
If you cancel before any work has begun, materials have been ordered, or permits have been filed, you may be eligible for a partial refund of your deposit
-
A cancellation fee of up to 25% of the deposit may be retained to cover administrative costs, design time, and scheduling commitments
-
The specific cancellation terms will be outlined in your project contract
After Work Has Commenced:
-
Once work has begun, materials have been ordered, or permits have been filed, deposits are generally non-refundable
-
You will be responsible for costs incurred up to the point of cancellation
Right to Cancel Period
In accordance with Pennsylvania consumer protection laws, you may have a right to cancel certain types of contracts within three (3) business days of signing. This "cooling-off period" will be specified in your contract when applicable. If you cancel during this period, you may be entitled to a full refund of any deposits paid, minus any costs already incurred.
Progress Payment Refunds
Payment for Completed Work
Progress payments are made based on work completed at specific project milestones. These payments are non-refundable as they compensate us for:
-
Labor already performed
-
Materials already installed
-
Subcontractor services already rendered
-
Equipment and tool usage
Unsatisfactory Work
If you are dissatisfied with the quality of work performed, refunds are not automatically provided. Instead, we will:
-
Investigate your concerns promptly
-
Work with you to identify specific issues
-
Take corrective action to remedy any deficiencies in our workmanship
-
Complete any punch-list items as specified in your contract
Our goal is to ensure your satisfaction through correction and completion of work, rather than through refunds.
Project Cancellation by Customer
Mid-Project Cancellation
If you choose to cancel a project after work has commenced:
-
You are responsible for payment of all work completed to the date of cancellation
-
You are responsible for all materials purchased for your project, whether installed or not
-
You are responsible for any costs incurred for permits, subcontractors, or other third-party expenses
-
No refund will be provided for payments already made
-
A final accounting will be prepared showing all costs incurred
Partial Refunds
In rare circumstances, if you have made payments that exceed the value of work completed and costs incurred, we will refund the difference within 30 days of final project accounting.
Project Cancellation by Totality Contracting
Our Right to Cancel
We reserve the right to cancel a project and provide appropriate refunds if:
-
Site conditions make it impossible to safely or legally complete the work
-
You breach the terms of the contract (e.g., non-payment, denial of site access)
-
Circumstances beyond our control make project completion impossible
Refund in Case of Our Cancellation
If we cancel a project for reasons within our control (excluding customer breach), you will receive:
-
A refund of any payments made that exceed the value of work completed
-
Credit for any materials that can be returned to suppliers (less restocking fees)
-
A final accounting within 30 days of cancellation
If we cancel due to your breach of contract, no refund will be provided for payments that equal or are less than the work completed and costs incurred.
Change Orders and Modifications
Scope Changes
If you request changes to the original scope of work:
-
Additional costs will be documented in a written change order
-
Payments for change orders are subject to the same refund terms as the original contract
-
Reductions in scope may result in credits against future payments but will not result in refunds for payments already made
Warranty Work vs. Refunds
Covered Under Warranty
If defects or issues arise that are covered under our workmanship warranty (as specified in your contract), we will:
-
Repair or correct the defective work at no additional charge
-
Complete the work to meet the standards specified in the contract
Warranty coverage does not entitle you to a refund but rather to correction of the work.
Not Covered Under Warranty
We are not responsible for refunds related to:
-
Normal wear and tear
-
Damage caused by misuse, abuse, or lack of maintenance
-
Changes in your preferences or design choices after work is completed
-
Issues arising from conditions beyond our control (e.g., settling, ground movement)
-
Manufacturer defects in materials (these are covered by manufacturer warranties)

Any requests for refunds must be made:
-
In writing via email or certified mail
-
Within 30 days of the event giving rise to the refund request
-

Processing Time
If a refund is determined to be appropriate:
-
We will process the refund within 30 business days of approval
-
Refunds will be issued via the original payment method when possible

If the original payment method is not available, we will issue a check
Materials and Supplies
Custom Materials
Materials purchased specifically for your project are generally non-refundable because:
-
They are custom-ordered to your specifications
-
They may not be returnable to suppliers
-
They may be subject to restocking fees
-
They have no use in other projects
Return of Unused Materials
If materials remain unused at project completion or cancellation:

We will attempt to return materials to suppliers where possible
-
You will receive credit for returned materials, minus any restocking fees (typically 15-25%)
